§1 SUBJECT OF THE OFFER
- The subject of the offer is participation in the British Camp “Town location” camp (“Camp”).
- Participation in the Camp is possible on dates set by the Organiser. The Guardian chooses one of the following periods:

- Duration of the Camp: 7 days.
- The Camp Organiser provides:
- Accommodation in 2-4 person rooms of high standard with floor facilities;
- Meals in accordance with the principles of children and youth nutrition: 3 meals a day (breakfast, two-course lunch, dinner);
- Supervision by educators, instructors, and managerial staff with appropriate qualifications and years of experience;
- Classrooms for English language classes equipped with modern equipment and high-quality teaching materials;

- Personal accident insurance (NNW);
- An attractive language-sports program:
- 18 academic hours of English language per week with native speakers,
- At least 20 hours of sports and other activities per week,
- At least 20 hours per week of English-speaking projects, activities, and quizzes (exclusively in English in groups of 12-15 people),
- Use of phones and other gadgets at designated times,
- Use of infrastructure and participation in the following activities:
- Football field, tennis court, basketball court, gardens, indoor swimming pool, equestrian center, gyms with exercise equipment, event and performance halls,
- Professional football or tennis and cricket depending on the program,
- Basketball, fan sports such as dodgeball, giant volleyball, and capture the flag,
- Esports championships,
- Yoga club, stretching,
- Watching movies in English,
- Evening intellectual, team-building, dancing, and vocal events,
- One trip to London and an overnight stay in London every second week of the camp
- Excursions to neighboring cities of Somerset County.

After participating in the Camp, the participant receives:

Certificate for achievements,
- Teacher’s report on English language learning achievements,
- Link to an online photo report with professional pictures.

§ 2
PAYMENT CONDITIONS
- The fee for participation in the Camp is specified in the Price List, available on the website: https://british.camp/en/camps/town-location-eng/
- The payment method is regulated in § 4 General Terms and Conditions.
§ 3 FINAL PROVISIONS
- Attachments to the Offer are an integral part of it:
- Attachment No. 1 – General Terms and Conditions of Participation (“GTC”),
- Attachment No. 2 – Information clause regarding personal data processing,
- Attachment No. 3 – Additional information about NNW insurance.
- By registering the Participant for the Camp through the registration form, the Guardian confirms acceptance of the Offer, as well as having read and fully accepting the GTC..

GENERAL TERMS OF PARTICIPATION IN THE LANGUAGE CAMP ORGANIZED BY BRITISH CAMP SP. Z O.O.
§1 GENERAL PROVISIONS

- The Organizer of the camp is the company British Camp Sp. z o.o. (KRS: 0001003726, NIP: 5242956029, REGON: 523747665) with its registered office in Warsaw, ul. Modlińska 6A, lok. 222.
- The General Terms of Participation in the Language Camp organized by British Camp Sp. z o.o. („GTOP“) define the rights and obligations of individuals participating in the camp („Participants“) as well as the rights and obligations of individuals entering into an agreement to participate in the camp („Guardians“).
- Participants in the camp are minors, and their participation requires written consent for their involvement by their Guardian. All legal actions related to the conclusion of the agreement are carried out by the Guardian.
- The conclusion of the agreement with the Guardian regarding participation in the camp occurs after their familiarization with and acceptance of the offer, the GTOP, and other applicable regulations, all statements, as well as providing complete contact details and making the reservation fee payment within the specified period.
- On the day of return from the camp, participants are picked up from the meeting point by the Guardian. In the case of the participant returning independently from the meeting point or being picked up by someone other than the Guardians, the Guardian is obliged to write a relevant declaration authorizing another person to pick up and deliver this declaration personally to the Organiser.
- Participants are under the care of the Organiser from the moment the Guardian hands over the Participant on the day of departure until the child is picked up on the day of return from the camp.
§2 DEFINITIONS
The terms used in the General Terms of Participation are defined as follows:
Organiser – British Camp Sp. z o.o. (KRS: 0001003726) with its registered office in Warsaw, ul. Modlińska 6A, lok. 222
Participant – a person registered for the camp by their legal guardian
Guardian – legal guardian of the camp participant
Camp – language camp organized by British Camp Sp. z o.o.
Agreement – Agreement on participation in the language camp
GTOP – General Terms of Participation in the Language Camp organized by British Camp Sp. z o.o.
§ 3 PARTICIPANT REGISTRATION
- To register a Participant for the camp, the Guardian is obligated to complete and electronically submit the Participant registration form available on the Organiser’s website.
- After successfully filling out and submitting the form, the Guardian is required to make a reservation payment, as specified in § 4 (1) of the GTOP, to confirm the registration. Upon recording the reservation payment, the Organizer provides the Guardian with camp documents.
- The Guardian is obligated to complete and submit to the Organiser the camp documents, including:
- Participant’s qualification card and the card’s attachment – no later than on the day of departure to the camp;
- Necessary declarations and authorizations – no later than on the day of departure to the camp;
- Statements regarding the Participant’s health condition and allergies to medicines or foods – no later than on the day of departure to the camp.
- The Guardian must inform the Organiser about the special educational needs of the Participant, especially those arising from disabilities, social maladjustment, or the risk of social maladjustment, by entering this information during the camp participation registration in the registration form.
- If the Participant suffers from a chronic illness that increases the risk of a severe course of COVID-19, the Guardian is obliged to inform the Organiser about this fact during the camp participation registration in the registration form.
- If the Participant takes regular medication, the Guardian is required to provide them on the day of departure to the camp to the Organiser’s representative along with written information on the dosage.
§ 4 PAYMENT TERMS
- Within 5 working days from the date of registering the Participant, as mentioned in § 3 above, in order to successfully complete the Participant’s registration, the Guardian is required to make a reservation payment amounting to 30% of the camp participation fee.
- The Guardian is obligated to pay the remaining part of the camp participation fee no later than 30 days before the camp starts. The payment date is determined by the date of the payment being credited to the Organiser’s account.
- The reservation payment is credited towards the payment for participation in the camp.
- The Guardian shall make payments via bank transfer to the bank account of the Organizer held by Bank PKO S.A., account number 55 1020 1042 0000 8102 0524 3946.
- The payment date is considered to be the day on which the Organiser’s bank account is credited.
- The Guardian authorizes the Organiser to issue a VAT invoice without their signature.
§ 5 RIGHTS AND OBLIGATIONS OF THE PARTIES
- The Organiser is responsible for non-performance or improper performance of the Agreement on participation in the camp unless such non-performance or improper performance is solely caused by:
- Actions or omissions of the Participant or their Guardian;
- Actions or omissions of third parties not involved in the provision of services specified in the agreement, provided that these actions or omissions could not have been foreseen or avoided;
- Force majeure.
- The Organiser is liable for non-performance or improper performance of services, but not exceeding the camp price.
- The Organiser is not responsible for stolen, lost, or damaged belongings of the Participant.
- Due to the specific nature of the camp, valuable items (phones, tablets, cameras, electronic devices, etc.) should be left at home.
- Due to the camp’s schedule, phone usage is limited (only 1.5 hours per day). During other hours, the Organiser reserves the right to store Participants’ phones in special lockers.
- The Organiser is obliged to ensure the Participants are supervised by qualified instructors and counselors and to oversee their work during the camp.
- The Organiser is obligated to inform the Guardian, regardless of the time of day, in case a situation requires the Guardian’s intervention.
- In the event of unforeseen circumstances beyond the Organiser’s control before the start of the camp, leading to the Organiser being forced to change essential contract terms, the Organiser will promptly notify the Guardian in writing or by another effective means. In such a situation, the Guardian should promptly inform the Organiser whether they accept the proposed contract changes or terminate the contract with an immediate return of all provided services and without the obligation to pay contractual penalties or other costs and fees.
- The Organiser reserves the right to change the camp program due to prevailing weather conditions or other justified circumstances. However, these changes must not result in significant alterations to the agreement, and the standard and quality of services provided must be maintained.
- The Guardian acknowledges that:
- The Participant is obligated to strictly follow the instructions of the instructional staff, adhere to all camp regulations, and comply with the laws on the camp premises;
- The Participant is subject to an absolute prohibition on consuming and possessing alcohol, as well as smoking tobacco or using and possessing narcotics;
- The Participant is required to take care of the property within the recreational complex, observe its operational rules, and adhere to safety regulations;
- The Participant commits to refraining from using mobile phones, tablets, portable gaming consoles, etc., during the day (except for the designated time for such activities);
- The Participant commits to not using hoverboards, boards, and other vehicles;
- The Participant commits to not leaving the recreational complex independently, including with parents, without written consent from the Organizer’s representative;
- The Participant commits to not using recreational areas (pools, playgrounds, all attractions) without the supervision of the recreational complex’s representative;
- The Participant commits to respecting others;
- The Participant commits to not playing with wild animals and not approaching them;
- The Participant commits to not using anything outside the recreational complex’s restaurant without the consent of the responsible person;
- The Participant commits to not bringing or storing food in residential premises;
- The Participant is obligated to adhere to standards, safety principles, fire safety, environmental protection principles, and general principles of public order, as informed on the first day of the camp;
- The Participant commits to not viewing or disseminating obscene photos and video materials, games, texts, and other materials not intended for viewing by individuals under 18 years of age;
- The Guardian shall be obligated to repair any damages caused by the Participant both within the recreational center and outside of it, inflicted upon both the Organizer and third parties;
- The Participant is obligated to contribute to creating conditions that prevent causing physical, material, or moral harm, particularly by adhering to general norms and principles, laws related to cybersecurity, protection of personal goods by refraining from using physical or psychological violence, any form of discrimination, humiliation, intimidation, spreading false information, etc.;
- The Participant commits to not staying in residential and restroom areas designated for the opposite gender;
- The Participant commits to not lean over the staircase railing, not open windows independently, and not exit through them from the room.
- In the event of the Participant’s flagrant non-compliance with regulations, instructions from the instructional staff, especially in the case of alcohol consumption, tobacco smoking, drug use, or the use of similar substances, use of vulgar language, hindering the efficient implementation of the program, and posing a danger to themselves or others, the Organiser reserves the right to remove the Participant from the list of camp participants (disciplinary expulsion).
- The Organiser will promptly inform the Guardian of the decision regarding the removal of the Participant from the list of camp participants. In such a case, the Guardian is obliged to immediately collect the Participant at their own expense.
- The Guardian consents to the use of the Participant’s image for promotional purposes related to the Organiser’s activities. The use of the image may include its placement in publications, on websites, and in printed promotional materials. The consent is voluntary and can be withdrawn at any time.
- The Guardian consents to testing the child with a breathalyzer or drug tests if there is suspicion of drug or alcohol consumption by the Participant, as well as to conducting an anti-COVID-19 test in case of symptoms indicating infection with the SARS-CoV-2 virus. The Organiser ensures that they will always try to contact the Guardian beforehand.
- The Guardian consents to providing medical assistance and administering medication in situations where the Participant’s life is at risk.
§ 6 CONDITIONS FOR RESIGNATION FROM PARTICIPATION
- The Guardian may resign from participation in the Camp on their initiative, i.e., for reasons attributable to the Participant, thereby terminating the agreement on camp participation immediately.
- The date of termination of the agreement is considered to be the day the declaration of termination reaches the Organiser.
- The reservation fee is non-refundable in the event of the Participant’s resign from the Camp before its commencement, with the stipulation that the Guardian will be entitled to a discount on the camp participation fee in the following calendar year, in an amount equivalent to the reservation fee. The Guardian is not entitled to receive the equivalent of the reservation fee in cash.
- In the event of resign from the Camp during its duration, the reservation fee is non-refundable, and the Guardian is not entitled to the discount mentioned in paragraph 3 above. The Guardian is entitled to a refund of a portion of the camp fee, proportionate to the number of unused days, excluding the reservation fee.
- In the case of disciplinary expulsion during the Camp, i.e., removal of the Participant from the list of camp participants, for reasons specified in § 5 (11) of the GCOP, the equivalent of the unused services mentioned in paragraph 4 above will not be refunded and will be credited towards the contractual penalty for violating the provisions of the GTOP. The Guardian consents to offsetting the amount mentioned in the preceding sentence.
§ 7 CANCELLATION OF THE CAMP, AMENDMENT OF CONTRACT TERMS
- The Organiser may terminate the contract for participation and provide a full refund of payments made for the language camp without additional compensation or redress if they cannot fulfill the contract due to unavoidable and extraordinary circumstances. The Organiser will notify the Guardian of the termination of the contract for participation in the language camp, either by phone or via email, immediately before the Camp starts.
- Without the Organiser’s consent, the Guardian cannot transfer to another person, who meets the camp participation conditions, all rights arising from the contract for participation in the camp, even if that person simultaneously assumes all obligations arising from this contract.
- The transfer of rights and assumption of obligations, as mentioned in paragraph 2 above, is effective towards the Organiser if the Guardian informs them within a reasonable time. Notification made no later than 7 days before the start of the Camp is considered in any case as timely.
- If the transfer of rights and assumption of obligations, as mentioned in paragraph 2 above, results in additional costs for the Organizer, and they demand payment, they are obliged to demonstrate these costs to the Guardian. These costs must be reasonable and cannot exceed the actual costs incurred by the Organiser due to the transfer of the contract.
- The Guardian and the person taking over their rights are jointly liable for the unpaid part of the camp fee and the costs incurred by the Organiser as a result of changing the participant in the camp.
- The declaration of the transfer of rights and assumption of obligations must be made in writing. The effectiveness of statements and notifications made by the Guardian via email requires confirmation of receipt of correspondence by an employee of the Organiser.

§ 8 COMPLAINTS
- In the event of non-performance or improper performance of the contract for participation in the language camp by the Organiser or a person cooperating with them, the Guardian has the right to file a complaint.
- If the Participant observes defective performance of the contract by the Organiser during the camp, the Guardian should immediately notify the Organiser.
- Complaints in written form should be submitted by the Guardian of the participant to the Organiser within 30 days from the end of the particular camp session to which the complaint pertains – under the penalty of losing the right to have the complaint considered.
- The Organiser is obliged to consider the complaint within 30 days from the date of its receipt.
- The consideration of the complaint completes the complaint procedure conducted by the Organiser.
§ 9 GDPR
- The administrator of personal data collected for the purpose of concluding and implementing the Agreement on participation in the camp is the Organiser.

§ 10 FINAL PROVISIONS
- If the agreement on participation in the language camp regulates specific issues differently than the GTOP, the provisions of the Agreement take precedence.
- The Organiser declares that they will fulfill all necessary conditions required for organizing leisure activities for children.
- The language camp offered by the Organiser’s school will be reported and approved by the Education Board in Warsaw.
- Participants in the camp are insured against the consequences of accidents from the day the camp starts until its completion. The scope of personal accident insurance (NNW) is 10,000 PLN. NNW insurance does not cover medical benefits in the territory of Poland. For Polish citizens, these benefits are reimbursed under the National Health Fund. Participants who are not Polish citizens are required to purchase personal liability insurance in Poland or possess a document authorizing cashless medical treatment.

INFORMATION CLAUSE ON THE PROCESSING OF PERSONAL DATA
1. According to Art. 13 sec. 1 and sec. 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC of 27 April 2016 (Official Journal of the EU. L No. 119, p. 1) – hereinafter referred to as “Regulation”, “GDPR” or “GDPR Regulation”, we inform that:

In the event that the contract for participation in a language camp is concluded with a minor under the age of 16 or with a legal representative of a minor under the age of 13, the personal data of the minor and his legal guardian are processed by the Administrator – a declaration of consent in this regard is submitted by the guardian legal.
6. In the event that the contract for participation in a language camp is concluded with a person who is over 16 years of age, the personal data of the minor and his legal guardian are processed by the Administrator – a declaration of consent to the appropriate extent is submitted separately by the minor and his legal guardian.
7. The following statements should be understood accordingly, taking into account the statements contained in points 3 and 4 above.
8. Information about downloaded/collected data:a) the legal basis for the processing of your personal data indicated in the consent form is, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free the flow of such data and repealing Directive 95/46/EC, including Art. 6 sec. 1 lit,
b) The administrator processes your personal data in connection with the services provided to you on the basis of a contract for participation in a language camp, in particular, but not exclusively: adjusting the appropriate training mode, providing access to training materials, maintaining an internal database customers,
c) The Administrator reserves the right to process the telephone number and e-mail address provided by you in order to contact you in connection with the language camp being conducted,
d) You may withdraw your consent at any time. However, withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal
e) Providing data is voluntary, but necessary for the purposes of implementing the concluded contract for participation in the language camp. Refusal to provide personal data results in the inability to accept and participate in a language camp organized by British Camp sp. z o.o.
f) Categories of processed personal data: ordinary category personal data and sensitive (special category) data.
g) Your data will be processed for the period of participation in the task or the period necessary to ensure the continuity of the task, i.e. until the task is settled and the archiving of documentation is completed.
h) The data provided by you will not be subject to profiling.
i) Your personal data will not be transferred to a third country or an international organization
7. In connection with the processing of personal data by the Administrator, you are entitled to:
a) the right to access the content of the data pursuant to art. 15 of the Regulation, with the proviso that the personal data provided do not violate legally protected secrets,
b) the right to rectify data pursuant to art. 16 of the Regulation,
c) the right to delete data pursuant to art. 17 of the Regulation,
d) the right to limit data processing pursuant to art. 18 of the Regulation,
e) the right to object to data processing pursuant to art. 21 of the Regulation,
f) the right to withdraw consent at any time,
g) the right to lodge a complaint with the supervisory body, i.e. the President of the Office for Personal Data Protection.
