INTERMEDIARY SERVICES REGULATIONS (United location)

    §1 General Provisions

    The Regulations specify the terms and conditions of the British Camp’s intermediary services for the purchase for participants of a language camp of transportation tickets and, in certain cases, accommodation during the journey to and from the location of the language camp. The Regulations also define British Camp’s obligations to provide a group of language camp participants with guide assistance and meals during the journey.

    § 2 Definitions

    1. British Camp – BRITISH CAMP Limited Liability Company with its registered office in Warsaw, ul. Modlińska 6A/222, 03-216 Warsaw, entered into the register of entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, XIV Economic Division of the National Court Register, KRS 0001003726, NIP 5242956029, REGON 523747665. 
    2. Client – the legal guardian of a participant of the language camp.. 
    3. Language camp – an educational event, involving the delivery of a foreign language learning program to participants along with additional cultural and recreational activities. 
    4. Participant – a person registered by the Client, meeting the specified criteria for participation in the language camp. 
    5. Transport ticket – a document issued by a carrier, entitling the holder to use transport services. 
    6. Accommodation – a place where participants of the language camp are housed, and services related to accommodation are provided. Accommodation may include single, double, triple, or quadruple rooms, according to the available options and the Client’s choice. 
    7. Guide – a person responsible for professionally guiding and taking care of participants during the language camp journey. His main task is to ensure a safe, organized, and comfortable journey. 
    8. Services – include the purchase of transportation tickets, the purchase of accommodation during the journey (in specific cases), and the provision of guide assistance and meals for the duration of the journey.

    § 3 Registration

    1. The condition for the Client to benefit from the Services is the payment of the remuneration referred to in § 7. 
    2. The Client undertakes to provide necessary data and information essential for British Camp to fulfill its obligations. 
    3. The Client undertakes to ensure that the Participant will possess the necessary documents allowing them to cross the border, transit and legally stay in the destination country. 
    4. The Client is entitled to conclude an individual agreement with British Camp, the nature of which will be complementary to the Regulations.
    5. The conclusion of an individual agreement is not mandatory, and the Regulations constitute the basis for the provision of Services by British Camp. An individual agreement may only be applied in cases where the parties agree that there is a need to regulate additional issues.

    § 4 Intermediary Service for the Purchase of transport Tickets

    1. British Camp undertakes to provide intermediary services consisting of purchasing transport tickets for participants of the language camp. Intermediary services include the selection by British Camp of suitable means of transportation, the purchase of tickets for specified routes, dates, and travel times, as well as providing necessary information to Clients and participants. 
    2. British Camp will make every effort to ensure ticket availability and achieve the intended travel goal.
    3. British Camp is not responsible for the unavailability of tickets for specific routes or the number of seats in transport. 
    4. British Camp undertakes to provide Clients with all necessary information regarding purchased tickets, including locations, dates, and departure and arrival times, no later than 7 days before the planned start date of the camp. 
    5. In the event of cancellation or changes by the carrier to travel conditions, British Camp is not liable for this; however, it commits to taking appropriate actions to minimize any potential irregularities.

    § 5 Intermediary Service for Accommodation booking during the journey

    1. British Camp undertakes to provide intermediary services involving the purchase of accommodation during the journey. These services include selecting suitable accommodation tailored to the Client’s preferences and needs.
    2. Accommodation during the journey to the destination is optional and depends on the duration of the journey, the number of connections, and the waiting time for transfer to another mode of transport. The decision to stay overnight depends on the circumstances, of which British Camp will inform the Client in advance. 
    3. British Camp, no later than 7 days before the planned start date of the camp, provides the client with all necessary information regarding the reserved accommodation, such as the address, room type, availability of amenities, and any relevant details about the stay. 
    4. In the event of changes in accommodation availability or significant changes in the stay conditions, British Camp commits to informing the Client about any modifications.
    5. British Camp does not guarantee the availability of a specific type of accommodation or the number of spaces; however, it commits to making necessary efforts to find a satisfactory solution for the Client.

    § 6 Group Guide Services

    1. British Camp undertakes to ensure the presence of a group guide during the travel period for participants of the language camp. These services include professional guidance and care for the group participants during transportation, ensuring safety, comfort, and a positive atmosphere. 
    2. The guide will provide Participants with snacks and organize meals during the journey (which are included in the service price). 
    3. The group guide will be available and present during the journey, monitoring the participants’ well-being and responding to their needs. 
    4. The guide ensures clear communication with participants regarding the travel plan, anticipated stops, planned breaks, and other relevant information. 
    5. During the journey, the guide provides participants with cultural information about the places the group is traveling through to enrich the travel experience with historical and cultural context.

    § 7 Remuneration

    1. The remuneration for intermediary services is dependent on prices set by third parties, namely carriers, owners of accommodation facilities, and the guide’s remuneration.
    2. In consideration of the performance of the Agreement, British Camp will receive remuneration in the amount according to the information on the website: https://british.camp/en/camps/united-location-eng/
    3. The remuneration shall be paid within 3 days from the date of receiving the confirmation issued by British Camp, by bank transfer to the bank account indicated therein. 
    4. The Client consents to pay for services without a signature, in electronic form.
    5. The remuneration includes all services provided by British Camp under the Agreement, as well as services provided by third parties, especially covering the costs of purchasing transport tickets, accommodation and meals during the journey, and the assistance of the group guide. 
    6. British Camp reserves the right to stipulate that the non-utilization of transport tickets or accommodation by a language camp participant does not entitle the Client to request a refund of the remuneration.

    § 8 Liability Principles

    1. British Camp is not the organizer of transportation or accommodation; its role is limited to intermediation in concluding agreements with carriers and accommodation facility owners. 
    2. British Camp shall not be held responsible for the availability of documents allowing the Participant to cross the border, transit, and stay in the destination country.
    3. British Camp is not liable for the waiting time at the border, customs clearance of Participants, the process of airport procedures and delays caused by this matter. 
    4. British Camp is not liable for damages incurred without its fault or resulting from causes beyond its control. 
    5. British Camp is not responsible for any changes in the travel plan, transport schedules, or accommodation reservations made by third parties. 
    6. British Camp undertakes to take action in emergency situations, such as unexpected transport cancellations or accommodation problems, to find a satisfactory solution for the Client. 
    7. In the event of non-compliance or non-performance of services by third parties, Camp will take steps to pursue claims against them, subject to the rights vested in the Client

    § 9 GDPR Information Clause

    1. The administrator of personal data is BRITISH CAMP Limited Liability Company with its registered office in Warsaw, ul. Modlińska 6A/222, 03-216 Warsaw, entered into the register of entrepreneurs kept by the District Court for the capital city of Warsaw in Warsaw, XIV Economic Division of the National Court Register, KRS 0001003726, NIP: 5242956029, REGON: 523747665 (“Administrator”). 
    2. Contact with the Administrator is possible at the following email address: hello@british.camp;
    3. Personal data will be processed for the purposes of:
      a) fulfilling the contract, the subject of which is the provision of intermediary services to ensure transportation and accommodation for participants of the language camp (the legal basis is Article 6(1)(b) of the GDPR, i.e., the necessity of providing data for the performance of the Agreement),
      b) determining, pursuing, and defending its own claims (the legal basis for the processing of personal data is Article 6(1)(f) of the GDPR, i.e., the legitimate interest of the Administrator),
      c) fulfilling legal obligations (e.g., archival, own accounting) – for the period required by applicable law (the legal basis for the processing of personal data is Article 74(2) of the Accounting Act in connection with Article 6(1)(c) of the GDPR, i.e., the necessity of fulfilling legal obligations incumbent on the Administrator).
    4. The Administrator may potentially transfer personal data outside the European Union or the European Economic Area, especially by using IT tools, platforms, and functionalities whose providers are located outside the European Union or the European Economic Area.
    5. Personal data will be stored for the duration of the business cooperation or possibly until the expiration of mutual claims. 
    6. In connection with the processing of personal data, the right to:
      a) withdraw consent to the processing of personal data,
      b) object to the use of data,
      c) request deletion of data (the “right to be forgotten”),
      d) request restriction of data processing, access data, request correction of data
      e) data portability to another administrator. 
    7. Processed personal data are not used for automated decision-making, including profiling.
    8.  If the processing of personal data violates legal provisions, the right to lodge a complaint with the supervisory authority for the processing of personal data by the Personal Data Administrator is granted. Complaints can be submitted to the President of the Office for Personal Data Protection.

    § 10 Final Provisions

    1. British Camp reserves the right to amend the Regulations, committing at the same time to publish any such changes with appropriate notice on the website https://british.camp/en/ or inform the Client about the changes in another manner.
    2. Each amendment to the Regulations comes into effect and becomes effective after 14 days from the date of its publication on the British Camp website or notification of changes to the Client in another manner. 
    3. In the event of a significant change to the Regulations, the Client is entitled to withdraw from the Agreement within 14 days from the date of its publication on the British Camp website or notification of changes to the Client in another manner than the one concluded with British Camp. This right expires upon the entry into force of the amended Regulations. 
    4. The Regulations have been drawn up in two language versions – Polish and English. In the event of discrepancies, the Polish language version is considered binding.
    5.  The Regulations come into effect on 1.01.2024.
